These Terms & Conditions (“Terms”) apply to your use of silviapoldaru.com (the “Website”) and any purchase from Silvia Poldaru (“I”, “me”, “my”).

By using the Website and/or purchasing any product or service, you agree to these Terms.

2. What I sell

I currently offer:

  • Your Living Body Map: a personalised, bespoke offering created for you based on your submitted information (including birth data and questionnaire responses) and delivered digitally.

In the future, I may also offer:

  • Digital downloads (PDF and/or audio)

  • Self-paced containers delivered digitally (via email and/or a portal)

These Terms apply to all purchases unless a sales page includes additional terms for a specific product.

3. Eligibility

My products and services are intended for adults (16+) only. By purchasing, you confirm you meet this requirement.

4. Purchases and payment

  • Prices are displayed in GBP unless stated otherwise.

  • Payments are processed via Squarespace Payments. Upon purchasing from me, the system may give you an option to store your card details for any future purchases. It will do so via a secure storage. I will see your saved payment method but not the full card details.

  • You agree to provide accurate contact details so I can deliver your purchase.

If a payment fails, is reversed, or is flagged for fraud, I reserve the right to pause delivery and access until the issue is resolved.

5. Application-first process + right to decline

Your Living Body Map begins with an application form. By applying, you agree to provide honest and reasonably complete information.

I reserve the right to decline your application if I believe the offering is not the right fit or would not be appropriate.

No payment is made during the application process.

6. When work begins

For Your Living Body Map, you acknowledge that the work is bespoke and personalised.

Work begins once your funds have been transferred. This includes time spent reviewing your application and materials, preparing your personalised work, and the creation process itself.

7. Delivery method

Materials may be delivered via:

  • email, and/or

  • a client portal (where you can access your materials)

You are responsible for:

  • providing a correct email address

  • ensuring you can receive emails from me (including checking spam/junk folders)

  • keeping your portal login details secure (and not sharing access)

8. Portal access duration

If a portal is used, access is provided for as long as the portal exists.

If I plan to change, migrate, or discontinue the portal, I will provide reasonable notice in advance and, where practical, provide an alternative way for you to retain access to your materials (for example, via download or email delivery).

I do not guarantee “lifetime access” unless explicitly stated on a sales page.

9. Your responsibilities

For Your Living Body Map, you agree to provide accurate information, including date, time and place of birth.

If you later provide corrected information after work has begun, I may charge a revision fee depending on the extent of changes required.

10. Refunds and cancellations

All sales are final. I do not offer refunds.

This is especially important for Your Living Body Map, because it is bespoke, personalised, and work begins once funds have cleared.

No refunds will be provided for:

  • change of mind

  • deciding the offering is not for you after purchase

  • delays caused by incomplete or inaccurate information provided by you

  • inability to access materials due to issues on your side (e.g., incorrect email address, spam filters, portal login shared/lost), unless caused by my systems

Exception (required by law): Nothing in these Terms excludes your rights under applicable consumer law. If something you purchase is faulty, not delivered, or not as described, you may have legal rights and I will comply with the law.

Important note: If your application is declined under Section 5, you will receive a full refund.

11. Right to cancel

If you are a UK consumer, you may have legal rights to cancel some purchases within 14 days.

However, for bespoke/personalised services like Your Living Body Map, cancellation rights are limited once work begins. By purchasing it, you acknowledge and agree that:

  • the service is personalised to you, and

  • work begins once funds have cleared,

  • therefore you may lose the usual right to cancel once the creation process has begun.

For future digital downloads or portal-based digital content, where you receive immediate access, you will be asked to acknowledge that you lose the right to cancel once access begins.

12. Intellectual property and permitted use

All content provided on the Website and all materials delivered through Your Living Body Map, digital downloads, and self-paced containers are owned by me (or licensed to me) and protected by intellectual property laws.

You may:

  • use purchased materials for personal use only

You may not:

  • copy, reproduce, share, resell, redistribute, or upload materials anywhere (including file-sharing drives, group chats, or training platforms)

  • use my materials to create competing offers or derivative products

  • remove copyright notices or claim the work as your own

If you breach this clause, I may terminate your portal access and take appropriate action.

13. Testimonials

If you provide a testimonial, you give me permission to use it for marketing purposes, with your name or initials as agreed. You can request removal from future marketing, and I will make reasonable efforts to stop using it going forward.

14. Disclaimer

My work is educational and supportive in nature.

I am not a doctor, psychologist, psychotherapist, or mental health professional. Nothing on this Website or within any product is medical advice, diagnosis, or treatment.

You are responsible for your wellbeing and decisions. If you need medical or mental health support, seek help from a qualified professional.

16. Changes to Products or Services

I may update, improve or modify certain Digital Products at any time.

You may receive future versions of the modified Digital Products at no additional cost.

I remain the right to offer some updates or new features separately as paid products.

17. Limitation of liability

To the fullest extent permitted by UK law:

  • I am not liable for any decisions you make based on Digital Product content.

  • I am not liable for any changes to your circumstances resulting from the use of Digital Product content.

  • I do not guarantee any specific outcomes. Your results depend on the extent you engage with the materials.

  • My total liability for any claim relating to a purchase is limited to the amount you paid for that purchase.

Nothing in these Terms limits liability where it would be unlawful to do so (including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

18. Privacy

Personal data is handled according to my Privacy Policy.

19. Third-party tools and links

I may use third-party platforms to deliver services (e.g., payment processors, email platforms, portal software). I am not responsible for third-party outages or policy changes, though I will take reasonable steps to support you if issues arise.

The Website may include links to third-party websites. I am not responsible for their content or privacy practices.

20. Changes to these Terms

These Terms may be updated from time to time. The latest version will be posted on the Website with the updated date. Continued use after changes means you accept the updated Terms.

21. Governing law

These Terms are governed by the laws of the United Kingdom, and any disputes will be handled in the courts of that jurisdiction.
